ARTICLE 1 - IDENTITY OF BELVICO

Buyer: any natural person who, solely for non-professional purposes, acquires or uses products or services marketed by Belvico Food.
Distance contract: any agreement between Belvico Food and the Buyer regarding coffee or other products that is concluded within the framework of a system for distance sales or services organized by the supplier whereby, for this agreement, only one or more techniques for distance communication up to and including the conclusion of the agreement itself.
Website: the Belvico Food website, accessible at www.belvico.com
Distance communication technology: any means that can be used, without the simultaneous physical presence of Belvico Food and the Buyer, for the conclusion of the agreement between these parties.
ARTICLE 3 - APPLICABLE
Unless expressly agreed otherwise in writing, these General Terms and Conditions apply to every offer from Belvico Foods and to every Distance Contract concluded between Belvico Food and the Buyer.
These General Terms and Conditions apply to any offer made by Belvico Foods as an online retailer to the Buyer, any natural person who acquires or uses marketed products and/or services solely for non-professional purposes.
You must be at least 18 years old to place an order. If you are not 18, we ask that you have the order placed by your parents or legal guardian. If we become aware that the order has been placed by a minor, we reserve the right to refuse such order.
If a Distance Agreement is concluded electronically, the General Terms and Conditions together with the order confirmation form an integral part thereof; the Buyer accepts the application of the General Terms and Conditions through his order and can find and save or print them at any time on this website.
In the event that, in addition to these General Terms and Conditions, specific products or service conditions also apply, and if there are differences between the Additional Terms and Conditions and the General Terms and Conditions, the provisions of the Additional Terms and Conditions will in principle prevail over the General Terms and Conditions, unless stated otherwise. .
It is only possible to deviate from one or more provisions in these General Terms and Conditions if this has been expressly agreed in writing. In that case, the other provisions of these terms and conditions will remain in full force and effect.
General Terms and Conditions applied by the Buyer do not apply, unless expressly agreed to by Belvico Food.
Belvico Food reserves the right to change and/or supplement the General Terms and Conditions at any time for future orders.
By using the Belvico Food website and/or placing an order, the Buyer accepts these General Terms and Conditions as well as all other rights and obligations as stated on the website.
If at any time one or more provisions of these Terms and Conditions should be unlawful, void or for any other reason unenforceable in whole or in part, then such term shall be deemed severable from these Terms and Conditions and shall not affect the validity and affect the enforceability of the other provisions. These General Terms and Conditions constitute the entire agreement between the Buyer and Belvico Food with regard to the subject matter contained therein.
ARTICLE 4 - OFFERS AND CONCLUSION OF AGREEMENTS
Offers are valid as long as they are listed on the Website and while stocks last.
If the offer is subject to certain conditions, this will be explicitly stated in the offer.
Belvico Food always describes as completely and accurately as possible what they sell and how the ordering process will go. The description is in any case sufficiently detailed to allow you to make a good assessment. In the event that Belvico Food uses images for the products and/or services offered, these are displayed as accurately as possible and truthfully. However, to err is human and if Belvico Food has clearly made a mistake, it is not obliged to deliver. The images have no contractual value.
An agreement is concluded and final at the moment that an order confirmation has been handed over to the Buyer, or has been sent by e-mail to the e-mail address provided by the Buyer, and as soon as Belvico Food has approved the payment transaction with credit or debit cards. received by the card issuer.
In the event that the card issuer refuses to agree to the payment, Belvico Food cannot be held responsible for delays in delivery and/or non-delivery of the order placed by the Buyer. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
The consumer who purchases products from Belvico Food is the end consumer. The products may not be resold in any way.
ARTICLE 5 - ORDERS
To purchase a product online, the product must be added to the shopping cart, after which the Buyer's contact and billing information must be entered. After this, the Buyer can choose the method of delivery and the address: home address or billing address. In the last step, the Buyer will arrive at an overview page, where the General Terms and Conditions are accepted and payment is confirmed by pressing the order button with the caption “order with payment obligation” or a corresponding wording. When these steps have been completed, the purchase is final. After this moment it is no longer possible to change the billing data.
ARTICLE 6 - PRICES
All prices are expressed in euros and include VAT or any other tax imposed by the authorities.

The national net price is applied regardless of the country of delivery.
The price will be invoiced in the currency in which the Buyer has placed his order.
The Buyer owes the price agreed during the last step of the ordering process and which Belvico Food has communicated in its order confirmation. Obvious errors in the quotation, such as obvious inaccuracies, can also be corrected by Belvico Food after the agreement has been concluded.
Delivery costs are clearly communicated to the Buyer. With regard to certain payment methods, further conditions apply with regard to the delivery method and any costs. This will be clearly communicated to the Buyer.
ARTICLE 7 - PAYMENTS

Belvico Food can expand the payment options in the future. Expansion of payment options will also be announced via the Website.
In order to guarantee a secure payment and the security of the Buyer's personal data, the transaction data is sent encrypted with SSL technology over the internet. You do not need any special software to pay with SSL. You can recognize a secure SSL connection by the “lock” in the bottom status bar of your browser.
ARTICLE 8 DELIVERY AND DELIVERY TIME
All coffee products are delivered to the address specified by the Buyer when placing the order.
Orders are processed and delivered as quickly as possible. Belvico Food strives to deliver the order within the week that the individual order confirmation is sent. Any delay will in no way give rise to compensation. Incorrectly provided delivery addresses are the responsibility of the Buyer and may give rise to additional costs that will be recovered from the Buyer.
Products are only delivered in the countries for which the website allows delivery.
We do not serve overseas territories for France.
For UK we do not serve the Isle of Man or the Channel Islands. Due to Brexit legislation, we are unable to make deliveries to the UK with a value of more than £135 or equivalent in EUR at the prevailing exchange rate on the date of order.
For Spain, we do not serve islands, such as the Balearic Islands or the Canary Islands.
If a specified indicative delivery term is not met, Belvico Food will not inform the Buyer about this. The Buyer can always contact Belvico Food via the contact form in order to know a probable delivery date.
Shipments are always at the risk of Belvico Food. The Buyer should therefore not worry about the products that would be lost in the post. However, if the products are returned, the Buyer is responsible for the transport
As soon as the products to be delivered have been delivered to the specified delivery address, the risk with regard to these products is transferred to the Buyer.
From the moment of receipt by the Buyer, the Buyer must store the products at room temperature and protected from direct sunlight and moisture.
The Buyer or any other person must be present at the address provided at the time of delivery of the product to receive it.
Belvico Food is not liable for failed deliveries when: i. the Buyer provides an incorrect or outdated address, ii. No one is present at the address specified by the Buyer.
The total liability of Belvico Food in the event of a breach of its obligations shall in no event exceed the purchase price of the product in question.
Due to the nature of the product, PO box addresses not accepted.
ARTICLE 9 - RIGHT OF WITHDRAWAL
According to book VI of the Economic Law Code, there is no right of withdrawal for foodstuffs, perishable goods and products manufactured according to the Buyer's specifications. Every purchase is therefore final and will not be taken back by Belvico Food.
ARTICLE 10 - RETENTION OF TITLE
Ownership of a product, notwithstanding the actual delivery, only transfers to the Buyer after the latter has fully paid the payment due for this product, including reimbursement of interest and costs.
The Buyer may not tax, sell, resell, dispose of or otherwise encumber the products before the ownership thereof has passed.
ARTICLE 11 - LIMITATION OF LIABILITY
The Website is offered to you without any explicit or implicit guarantees as to its correct functioning. Belvico Food is not liable for damage resulting from the use of the Website, whether correct or incorrect, nor for damage caused by incorrect, incomplete, ambiguous or outdated content or language errors on the Website.
In any case, Belvico Food's liability for any damage will always be limited to the amount of the last order.
Belvico Food makes every effort to provide access to the Website 24 hours a day, 7 days a week. In view of the technical characteristics of the Internet and of the IT resources, and in view of the need to carry out periodic maintenance, update or upgrade work, however, Belvico Food cannot guarantee uninterrupted access and service to the Website. In the event of normally acceptable interruptions or disruptions to access, Belvico Food will make every effort to find a solution to the problem as quickly as possible. Such normally acceptable interruptions or malfunctions are inherent in Internet sales. These cannot be regarded as shortcomings and will not give rise to compensation.

ARTICLE 12 - CONFORMITY AND WARRANTY
Belvico Food guarantees that the products conform to the order placed and meet the normal expectations that the Buyer may have, taking into account the specifications of the product. In addition, Belvico Food ensures that its products comply with all laws existing at the time of the order.
The products sold by Belvico Food are fresh foods. Belvico Food does its utmost to ensure that a correct and safe delivery will take place, taking into account the freshness of its products, but cannot give an absolute guarantee about the quality of the transport.
Belvico Food delivers the products by courier/post. In the exceptional case that the quality of the delivery is nevertheless affected, the Buyer must provide proof of this immediately, immediately at the time of delivery. The Buyer is always obliged to inspect the products accurately (or have them inspected) immediately after receipt. Complaints from the Buyer, relating to defects in the product or the delivery, which are externally visible (for example, damaged during transport), must therefore be notified IMMEDIATELY by the Buyer to Belvico Food by telephone or e-mail and this at the latest within 4 hours of receipt.
ARTICLE 13 - FORCE MAJEURE
In case of force majeure, Belvico Food is not obliged to fulfill its obligations. In that case, it can either suspend its obligations for the duration of the force majeure or definitively dissolve the agreement.
Force majeure is any circumstance beyond the will and control of Belvico Food that prevents the fulfillment of its obligations in whole or in part. This includes but is not limited to: strikes, unexpected traffic jams, accidents on European roads, fire, business failures, energy failures, failures in a (telecommunications) network or connection or communication systems used and/or the unavailability at any time. of the website, non-delivery or late delivery from suppliers or other third parties engaged,…
ARTICLE 14 - INTELLECTUAL PROPERTY
The Buyer expressly acknowledges that all intellectual property rights of displayed information, communications or other expressions relating to the products and/or the Website are vested in Belvico Food, its suppliers or other entitled parties.
Intellectual property rights are understood to mean patent, copyright, trademark, drawing and model rights and/or other (intellectual property) rights, including technical and/or commercial know-how, methods and concepts that may or may not be patentable.
The Buyer is prohibited from using and/or making changes to the intellectual property rights as described in this article, such as, for example, reproduction without the express prior written permission of Belvico Food, its suppliers or other entitled parties, unless it concerns purely private use. of the product itself.
ARTICLE 15 - COMPLAINTS PROCEDURE
Belvico Food does everything possible to satisfy its customers 100%. Belvico Food has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
Every complaint is dealt with within 7 working days.
In the event of an out-of-court settlement of the dispute, the Consumer Ombudsman Service of the FPS Economy is authorized to receive any request for out-of-court settlement of consumer disputes. ARTICLE 16 - APPLICABLE LAW AND COMPETENT COURT
All offers and agreements are exclusively governed by Belgian law.
All disputes related to or arising from offers from Belvico Food or agreements concluded with it will be submitted to the competent courts and courts of Brussels, unless a mandatory legal provision expressly designates another court as competent.
